President Trump, one of the Democratic FTC commissioners, was fired in March, saying he was looking forward to returning to work. US District Judge Loren al -Khan has just ruled that removal of it from the agency is “without illegal and legal influence” and he is still a “right member” of the commission. The judge explained that the firing violated the reservations that prevent the president from unilaterally removing the officials of independent agencies.
In his statement after handing over the decision, Slater said that “the application of removal concerns in the FTC (its) and the removal of it also protects the SEC, the FDIC, and other independent economic regulators such as the Federal Reserve.” The Slaughter was one of the two Democratic members of the Federal Trade Commission, which was removed by Trump, and left only three Republican commissioners in charge.
Historically, there were five members of the FTC: from the same party like three presidents and two from the opposition party. Currently, the FTC website contains only three existing Republican Commissioners, including Chairman Andrew Ferguson. The chairman had earlier said that there was no doubt about the (Trump) constitutional authority to remove the commissioners, which must ensure democratic accountability for the government. “The other fired Democratic Commissioner, Alwar Badwia, was actually part of the litigation. However, his claims were rejected since he had completely resigned from the agency and received a private sector job since then, explaining that the case was in court.
White House spokesman Kosh Desai said New York Times That the administration will appeal to Al Khan’s decision. He added, “The Supreme Court has repeatedly retained repeatedly to oust the president’s constitutional authority and remove executive officers who exercise their powers.” The judge had expected it and in his decision he noted that the case would likely reach the Supreme Court. As if Polyteco Noted, the Supreme Court had earlier refused to restore members of the National Labor Relations Board and Merit Systems Protection Board, which was fired by Trump. It was believed that these personnel should also be protected by federal law, the president’s ability to remove official agency officials was banned.
