The US International Trade Commission has vowed that the Chinese camera company Insta 360 has at least violated some of Gopro’s patent. Based on a press release by Go Pro, the commitment has been specifically revealed that “Insta 360 violated the federal law by importing and selling in the United States products that violate the Gopro intellectual property.”
Go Pro especially “happy” to the ITC judge that the Institution TA 360 violated “Gopro’s famous hero camera design covering a patent cover” and he confirmed numerous patent claims related to the company’s hypermith video stability feature. The company released the latest version of its flagship action camera, Go Pro Hero 13 in September 2024.
When asked to comment on the notice of the ITC commitment, Insta 360 did not present the decision as a final victory for Go Pro. If anything, the company’s statement tries to look the opposite. The Insta -360 press release states that the ITC “rejected Go Pro’s Utility Patent claims against Insta 360.” According to the company, the judge vowed that utility patent “stability, horizontal levels, distortion and aspect proportion are wrong, not violated, or both.”
“The preliminary commitment of the US International Trade Commission confirms that many people in our industry already know: the future belongs to the innovators, not the legislators,” the CEO of Insta 360 shared in the company’s press release. “Although Gopro tried to stop the competition by emphasizing a vast array of patents, the majority of these claims were either found or either not violated or the wrong decision was not made. It speaks volume.”
ITC initially began investigating Insta360 on Gopro’s advice, Reuters Reports, the company was especially “looking for the removal and removal and orders that would ban the import of Insta -360 products in the United States”. Even if the ITC has found ways to violate Insta 360 on GOPRO patents, the preliminary commitment does not prevent the company from importing and selling its camera. You are still able to buy Insta 360 products in the United States.
According to Go Pro, the ITC is expected to finalize on November 10, 2025. If the company is known to be defensive, this is a good reason. Even if Go Pro in action cameras is still the most recognizable name, Insta 360 offers very broad, and in some cases, the product’s more charming selection.
